Article 2: Purpose and scope

These Terms apply to two distinct categories of service:

  • the immersive French language stays in homestay accommodation with the teacher, which constitute package travel within the meaning of Articles L.211-1 et seq. of the French Tourism Code (Articles 3 to 14);
  • the online French lessons, sold individually or as a pack (Article 15).

The provisions specific to package travel (Articles 3 to 14) do not apply to the online lessons, which are governed exclusively by Article 15.

Article 3: Description of the immersive stays

Azur Immersion offers immersive language stays at the teacher’s home, in Fayence (Var). Two packages are offered:

6-day package

• From Sunday 2 p.m. to Saturday 2 p.m.;
• 15 hours of French lessons (5 sessions of 3 hours);
• 5 cultural activities of your choice;
• accommodation in a single or double room with a private bathroom;
• full board;
• 2 hours of preparatory video call before the stay;
• return transfer from Nice airport or a railway station (Les Arcs, Saint-Raphaël, Cannes).

Weekend package (3 days)

  • From Friday 2 p.m. to Monday 2 p.m.;
  • 6 hours of French lessons;
  • 2 cultural activities of your choice;
  • accommodation, full board, preparatory video call and transfer under the same conditions as the 6-day package.

The number of participants hosted at the same time is limited to four (4). Activity programmes are tailored to the client’s interests and may be adapted according to the season, the weather and site availability. Bespoke stays may be arranged on quotation.

Article 4: Prices

Prices are stated in euros, all taxes included (VAT not applicable, Article 293 B of the French General Tax Code). They are per person and per stay. A distinction is made between high season (1 April to 30 September) and low season (1 October to 31 March).

Prices may be revised for future bookings. The applicable price is the one in force on the booking date, as confirmed in the booking agreement.

Article 5: Pre-contractual information

In accordance with Article R.211-4 of the French Tourism Code, before the contract is concluded the client receives the standard information form below as well as all the information relating to the stay (features, price, payment terms, cancellation and amendment conditions).

 

Standard information form

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the French Tourism Code. You will therefore benefit from all the EU rights applying to packages. Azur Immersion will be fully responsible for the proper performance of the package as a whole.

Key rights under the French Tourism Code:

Travellers will receive all essential information about the package before concluding the package travel contract. Azur Immersion is responsible for the proper performance of all the travel services included in the contract. Travellers are given an emergency telephone number or the details of a point of contact. Travellers may transfer the package to another person, subject to reasonable notice and possibly to additional costs. The price of the package may only be increased if specific costs rise and only where the contract expressly provides for it; if the increase exceeds 8% of the price of the package, the traveller may terminate the contract. Travellers may terminate the contract without paying any termination fee and obtain a full refund if any of the essential elements of the package are significantly changed. Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional and unavoidable circumstances. Travellers may terminate the contract at any time before the start of the package in return for payment of an appropriate and justifiable termination fee. If, after departure, significant elements of the package cannot be provided, suitable alternative arrangements will be offered at no extra cost. Azur Immersion has protection against insolvency (APST) to refund payments and, where applicable, to repatriate travellers.

Directive (EU) 2015/2302 transposed into French law: Articles L.211-1 et seq. of the French Tourism Code.

Article 6: Booking and formation of the contract

Bookings are made by electronic exchange or by any other means agreed between the parties. The booking request becomes firm and final upon the client’s receipt of Azur Immersion’s written confirmation and after payment of the deposit provided for in Article 7. The contract is deemed concluded on the date of that confirmation.

The client warrants the accuracy of the information provided when booking and declares having the legal capacity to enter into the contract.

Article 7: Payment terms

Payment for the stay is made in two instalments:

  • a deposit of 30% of the total price is paid on booking and is a condition for confirmation of the stay;
  • the balance, being 70% of the total price, is paid no later than one (1) week before the start of the stay.

If the balance is not paid within the stated period, Azur Immersion reserves the right to treat the booking as cancelled by the client and to apply the cancellation conditions set out in Article 9.

Article 8: Right of withdrawal

In accordance with Article L.221-28 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering and leisure services provided on a specific date or during a specific period. As the immersive stays fall within this category, they are not subject to the fourteen (14) day withdrawal period.

The cancellation conditions applicable to the stays are those set out in Article 9. The withdrawal regime specific to the online lessons is set out in Article 15.

Article 9: Cancellation and amendment of the stay

9.1: Cancellation by the client

Any cancellation must be notified to Azur Immersion in writing. Cancellation fees are retained according to the following scale, calculated on the total price of the stay:

 

Cancellation fee scale: 

More than 30 days before the start of the stay: retention of the deposit (30%).

From 30 to 15 days before: retention of 50% of the total price.

From 14 to 7 days before: retention of 75% of the total price.

Less than 7 days before, or no-show: retention of 100% of the total price.

 

In accordance with Article L.211-14 II of the French Tourism Code, the client may terminate the contract before the start of the stay without paying cancellation fees in the event of exceptional and unavoidable circumstances occurring at the destination or its immediate vicinity and significantly affecting the performance of the stay. In that case, the client is reimbursed all sums paid, with no further compensation.

Azur Immersion strongly recommends that the client take out cancellation insurance (see Article 12).

9.2: Interruption of the stay by the client

If the stay is interrupted by the client, no refund may be claimed for services not used, save in a duly justified case of force majeure (in particular hospitalisation, serious accident or the death of a close relative). The client is invited to rely, where applicable, on their own insurance.

9.3: Amendment or cancellation by Azur Immersion

If Azur Immersion is forced to change an essential element of the stay, it informs the client as soon as possible. The client may then accept the change or terminate the contract and obtain a full refund of the sums paid.

If Azur Immersion cancels the stay, the client is fully reimbursed within fourteen (14) days, without prejudice to any compensation that may be due under Article L.211-14 of the French Tourism Code. No compensation is due where the cancellation results from exceptional and unavoidable circumstances.

Article 10: Transfer of the contract

In accordance with Article L.211-11 of the French Tourism Code, the client may transfer the contract to a person meeting the same conditions, as long as the stay has not yet begun, by informing Azur Immersion in writing within a reasonable period before the start of the stay. The transferor and the transferee are jointly and severally liable for payment of the balance of the price and of any additional costs arising from the transfer.

Article 11: Liability

In accordance with Article L.211-16 of the French Tourism Code, Azur Immersion is responsible for the proper performance of the services provided for in the contract. However, it cannot be held liable for any non-performance or improper performance of the contract that is attributable to the client, to the unforeseeable and insurmountable act of a third party unconnected with the provision of the services, or to exceptional and unavoidable circumstances.
The client remains liable for any damage they may cause during the stay and declares that they are covered by civil liability insurance for this purpose.

Article 12: Insurance

Azur Immersion holds professional civil liability insurance taken out with GAN Assurances.

The price of the stays does not include any personal insurance for the benefit of the client. Azur Immersion strongly recommends that the client take out, at their own expense, insurance covering in particular cancellation, assistance, repatriation and medical expenses. Foreign nationals are invited to check the validity of their health cover and of their travel documents (passport, and visa where applicable), the obtaining of which is their sole responsibility.

Article 13: Financial guarantee

In accordance with Articles L.211-18 and R.211-26 et seq. of the French Tourism Code, Azur Immersion benefits from a financial guarantee provided by APST (Association Professionnelle de Solidarité du Tourisme, 89 rue La Boétie, 75008 Paris). This guarantee covers the refund of funds received in respect of the stays and, where applicable, the repatriation of the client.

Article 14: Complaints and mediation

Any complaint relating to a stay must be sent to Azur Immersion in writing (marie@azurimmersion.com) as soon as possible.

In accordance with Articles L.611-1 et seq. of the French Consumer Code, the client has the right to use a consumer mediator free of charge with a view to the amicable resolution of a dispute, after having sent a written complaint that has not received a satisfactory response. The competent mediator is:

Article 15: Specific conditions for online lessons

Azur Immersion offers private French lessons by video call, all levels, lasting from 1 hour to 1.5 hours, independently of the immersive stays.

15.1: Prices

  • Single lesson (1.5 hours): €30.
  • Pack of 10 hours of lessons: €280, including 1 free needs-assessment hour.

15.2: Validity of the pack

The 10-hour pack is valid for six (6) months from the date of purchase. Any hour not used by the end of that period is forfeited, unless otherwise agreed in writing.

15.3: Cancellation and rescheduling of a lesson

Any lesson may be cancelled or rescheduled free of charge up to forty-eight (48) hours before the scheduled time. After that point, the lesson is payable and is deducted.

If the client fails to attend without prior cancellation (“no-show”), the lesson is payable, save in a duly justified case of force majeure.

15.4: Right of withdrawal (online lessons)

As the online lessons are sold remotely, the consumer client benefits from a fourteen (14)-day withdrawal period from the date of purchase, in accordance with Article L.221-18 of the French Consumer Code.
However, if the client wishes the lessons to begin before the expiry of that period, they must make an express request to that effect and acknowledge that, in the event of withdrawal, they will be required to pay for the hours already completed.
The right of withdrawal may no longer be exercised once the service has been fully performed.

Article 16: Image rights

During the stays, Azur Immersion may take photographs or videos (lesson moments, meals, activities) intended to illustrate its website and its social media. By booking, the client authorises Azur Immersion to use this content for communication purposes, free of charge and on a non-exclusive basis.

The client may at any time refuse to be photographed or request the removal of content concerning them, by simple written request to marie@azurimmersion.com. No image will be published against the express wishes of the client.

Article 17: House rules

As the stay takes place at the teacher’s home in a family setting, the client undertakes to respect the house rules provided with the booking confirmation and accepted before the start of the stay. Clear and repeated failure to respect these rules, or any behaviour affecting the safety or the peace of the household, may lead to the termination of the stay without refund.

Article 18: Personal data

The personal data collected in connection with bookings and services is processed in accordance with the applicable regulations. The terms of this processing and the client’s rights are detailed in the Privacy Policy available on the website.

Article 19: Governing law and jurisdiction

These Terms are governed by French law. They are drafted in French; any translation is provided for information only, and only the French version is authoritative in the event of a dispute. Failing an amicable resolution, and after recourse to the mediator, any dispute falls within the jurisdiction of the French courts under the conditions provided by law.
